Judge: 17,000 illegal downloads don't equal 17,000 lost sales
Record companies cannot collect restitution for every time a song has been illegally downloaded, a US District judge has decided. Judge James P. Jones gave his opinion onUnited States of America v. Dove, a criminal copyright case, ruling that each illegal download does not necessarily equate to a lost sale, and that the companies affected by P2P piracy cannot make their restitution claims based on this assumption.

Court rules that teachers can have sex with 18-year-old students
The Associated Press reports that the Washington Court of Appeals ruled that the state law that bars teachers from having sex with students doesn't explicitly include students who are 18 or older. The judges said the law is too vague.
This stems from a case involving a choir teacher at Hoquiam High School and an 18-year-old student in the choir. According to the opinion information sheet, no one denies the facts of the case --- it's the vagueness of the law that was called into question.
It would be interested to see how this might affect the person's teaching certificate, if it is determined that no crime was committed. A teacher found guilty of sex crimes against students have their licenses permanently revoked.
Or, perhaps the law will just get revised.
You can read the opinion for yourself. It's rather interesting how closely the judges parse the words "student" and "minor" to try to determine the intention of the law.

Prosecutors file to release recordings
CHICAGO (AP) - U.S. Attorney Patrick Fitzgerald wants lawmakers to hear what Gov. Rod Blagojevich says on wiretapped phone calls.
Fitzgerald filed paperwork Monday to release conversations caught on wiretaps to the Illinois House committee moving ahead to impeach Blagojevich.
Federal prosecutors have asked a judge for permission to disclose a limited number of the intercepted conversations in a redacted form.
Fitzgerald says disclosing four calls wouldn't interfere with the ongoing criminal investigation.
Blagojevich was arrested Dec. 9 on federal corruption charges. The governor is accused of trying to sell President-elect Barack Obama's vacant U.S. Senate seat to the highest bidder, but he's denied any wrongdoing.

Obama Interviewed In Blagojevich Probe
DECEMBER 23--President-elect Barack Obama and two of his top advisers were interviewed last week by federal prosecutors probing Illinois Governor Rod Blagojevich's alleged bid to sell Obama's vacated Senate seat, according to a report issued today by an Obama lawyer. The lawyer, Gregory Craig, concluded that Obama and his aides engaged in no improper conduct in connection with the Senate opening. A copy of the Craig report can be found below. As part of his review of transition team "contacts" with Blagojevich, Craig reported that only incoming White House Chief of Staff Rahm Emanuel had spoke with the Illinois pol. Emanuel, Craig disclosed, had "one or two telephone calls" with Blagojevich in early-November. Emanuel reportedly gave Blagojevich a "heads up" that he was accepting Obama's offer of the chief of staff job (and, as a result, would be resigning his congressional seat). Emanuel also "had a brief discussion with the Governor about the Senate seat and the merits of various people whom the Governor might consider." Craig also noted that Emanuel had "about four telephone conversations with John Harris, Chief of Staff to the Governor, on the subject of the Senate seat. In these conversations, Mr. Emanuel and Mr. Harris discussed the merits of potential candidates and the strategic benefit that each candidate would bring to the Senate seat." In addition to the president-elect, Emanuel and Valerie Jarrett, an Obama confidante, were interviewed in the past few days by investigators with the U.S. Attorney's Office in Chicago, which, on December 9, announced criminal charges against Blagojevich and Harris.

Sex among jurors could mean new trial
ST. LOUIS, Dec. 22 (UPI) -- A convicted murderer says his Missouri guilty verdict should be thrown out because two of his jurors allegedly had sex while sequestered at a hotel.
An attorney for Roberto Dunn, convicted eight years ago of killing his girlfriend's mother, is asking St. Louis Circuit Judge Julian Bush for a new trial because of the recently discovered alleged sexual escapades involving two jurors, the St. Louis Post Dispatch reported Monday.
Shortly after Dunn was convicted in 2000, Bush received a letter from a juror making the accusations against fellow jurors, and adding, "Sexual liberties by deputy sheriffs were rampant also," alleging that two sheriff's deputies guarding the jurors also had sex while on duty at the hotel.
Dunn's trial lawyers put the letter under seal and requested for a new trial but were refused. But his current attorney, Assistant Public Defender Lisa Stroup, says she found the letter and criticized the former attorneys whom, she said, should have pushed harder for a new trial, including calling the jurors as witnesses and quizzing them about the claims, the Post-Dispatch reported.
If the judge agrees with Stroup, he can give Dunn a new trial, the newspaper said.
